Terms of Use

These terms govern your use of wtxwaterwells.com. By using this website or submitting a service request, you agree to them. If you do not agree, please do not use the site. Please read these alongside our Privacy Policy.

What WTX Water Wells is

WTX Water Wells is a referral service. We connect property owners in Midland and Ector counties, Texas, with independent water well service providers.

We do not drill, repair, inspect or service water wells, pumps or pressure systems. We do not employ the providers we connect you with, and we do not supervise, direct or control their work.

Your relationship with a provider

Any agreement for work on your property is between you and the provider. That includes the scope of work, the price, the schedule, payment terms, and any warranty or guarantee.

We are not a party to that agreement. We do not set prices, and we do not collect payment for work performed.

Providers are independent businesses responsible for their own licensing, registration, insurance and compliance with Texas requirements for water well drilling and pump installation. We encourage you to verify a provider’s licensing and insurance directly before work begins. Water well drillers and pump installers in Texas are licensed through the Texas Department of Licensing and Regulation, and you can confirm a licence with them.

No warranty on work performed

We make no warranty or guarantee about any provider, or about the quality, timeliness, safety or cost of any work they perform. Any warranty on work is given by the provider carrying it out, not by WTX Water Wells.

Being listed or referred through this site is not an endorsement, certification or recommendation by us.

Information on this site is general

The service pages on this site describe what commonly causes particular symptoms and what the work typically involves. It is written to help you understand your situation before you make a call.

It is general information, not a diagnosis and not professional advice. No well, pump or pressure system can be properly assessed without a qualified person examining it on site. Do not rely on this site in place of a professional inspection, and do not attempt work that requires a licensed provider.

Water well systems involve electrical supply, pressurised water and confined spaces. Take care, and stop if you are unsure.

Your responsibilities

When you use this site you agree to:

  • Provide accurate and complete information, including a telephone number you are authorised to use.
  • Submit requests only for property you own or are authorised to arrange work for.
  • Not use the site unlawfully, or to send spam, false or abusive submissions.
  • Not attempt to disrupt, damage or gain unauthorised access to the site.
  • Not copy, scrape or republish the content of this site without permission.

By submitting a service request you agree that we and the providers we connect you with may contact you at the number and address you supply, including by automated dialling system, prerecorded message and text message. Consent is not a condition of purchase. Message and data rates may apply. You can opt out at any time as described in our Privacy Policy.

Content and trade marks

The text, layout, graphics and other content of this site belong to WTX Water Wells or its licensors and are protected by copyright and other laws. You may view and print pages for your own use in arranging work on your property. Any other use requires our written permission.

Links to other sites

This site may link to websites we do not control. We provide those links for convenience and are not responsible for their content, accuracy or practices.

Disclaimer of warranties

This website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the site will be uninterrupted or error free, that the information on it is complete or current, or that you will be matched with a provider.

Limitation of liability

To the fullest extent permitted by law, WTX Water Wells will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of this site or any work performed by a provider.

Our total liability for any claim relating to this site will not exceed one hundred US dollars (US$100.00).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold harmless WTX Water Wells and its officers, employees and agents from any claim, loss, liability or expense, including reasonable legal fees, arising from your use of this site, your breach of these terms, or any dispute between you and a service provider.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising from these terms or your use of this site will be brought exclusively in the state or federal courts located in Midland County, Texas, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the date below. Continuing to use the site after a change means you accept the updated terms.

Severability

If any part of these terms is found unenforceable, the remainder stays in effect.
